WARRANTY
FIVE YEAR LIMITED COMMERCIAL USE WARRANTY LED
Lighting Technologies Group, LLC Limited Warranty for LED bulbs, fixtures, and lights. THIS LIMITED WARRANTY applies solely to LED bulbs, fixtures, and lights manufactured by or on behalf of LED Lighting Technologies Group, LLC (“Standard LEDs”). Subject to the limitations herein, LED Lighting Technologies Group, LLC warrants that Standard LEDs, when delivered by LED Lighting Technologies Group, LLC or its authorized distributor, for five (5) years following the delivery date, will be free from defects in material and workmanship and will substantially conform to LED Lighting Technologies Group, LLC publicly available specifications for such products in effect at the time of delivery, INCLUDING the ability to maintain not less than 70% of the original specification stated brightness of light lumens.
This limited warranty excludes: (l) engineering samples (which are provided “AS-IS” without warranty); (ll) development products; (lll) Standard LEDs procured through unauthorized third parties; and (lV) Standard LEDs that have been subject to misuse, mishandling, accident, alteration, neglect, unauthorized repair or installation. Furthermore, this limited warranty shall not apply to the use of covered products in an application or environment that is not within LED Lighting Technologies Group, LLC specifications or in the event of any act, error, neglect or default of Customer. For any breach by LED Lighting Technologies Group, LLC of this limited warranty, the exclusive remedy of Customer and the sole liability of LED Lighting Technologies Group, LLC shall be, at the option of LED Lighting Technologies Group, LLC, to replace or repair the affected products, or to refund to Customer the price of the affected products. The availability of replacement products is subject to product discontinuance policies at LED Lighting Technologies Group, LLC. Customer may not return products without first obtaining a customer return material authorization (RMA) number from LED Lighting Technologies Group, LLC. THE WARRANTIES SET FORTH HEREIN ARE EXCLUSIVE. LED LIGHTING TECHNOLOGIES GROUP, LLC DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, AND ANY WARRANTY THAT MAY ARISE FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.
LED Lighting Technologies Group, LLC Limited Warranty for Development LED products. THIS LIMITED WARRANTY applies solely to development LED products manufactured by or on behalf of LED Lighting Technologies Group, LLC (“Development LEDs”). Subject to the limitations herein, LED Lighting Technologies Group, LLC warrants that Development LEDs), when delivered by LED Lighting Technologies Group, LLC or its authorized distributor, for ninety (180) days following the delivery date, will be free from defects in material and workmanship and will substantially conform to LED Lighting Technologies Group, LLC publicly available specifications for such products in effect at the time of delivery. This limited warranty excludes: (l) engineering samples or beta versions of Development LEDs) (which are provided "AS-IS" without warranty); (ll) Development LEDs) procured through unauthorized third parties; and (lll) Development LEDs) that have been subject to misuse, mishandling, accident, alteration, neglect, unauthorized repair or installation. Furthermore, this limited warranty shall not apply to the use of covered products in an application or environment that is not within LED Lighting Technologies Group, LLC specifications or in the event of any act, error, neglect or default of Customer. LED LIGHTING TECHNOLOGIES GROUP, LLC DOES NOT WARRANT THAT ES DEVICES ARE FULLY VERIFIED, TESTED, OR WILL OPERATE IN ACCORDANCE WITH DATA SHEET SPECIFICATIONS. LED LIGHTING TECHNOLOGIES GROUP, LLC DISCLAIMS ANY OBLIGATIONS FOR TECHNICAL SUPPORT AND REPAIR OF ES DEVICES. LED LIGHTING TECHNOLOGIES GROUP, LLC SHALL NOT BE LIABLE FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, SPECIAL, RELIANCE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR IN CONNECTION WITH THE USE OF ES DEVICES IN ANY MANNER WHATSOEVER, EVEN IF LED LIGHTING TECHNOLOGIES GROUP, LLC HAS BEEN ADVISED OF THE POSSIBILITY THEREOF. LED LIGHTING TECHNOLOGIES GROUP, LLC MAKES NO REPRESENTATION THAT ES DEVICES PROVIDE ANY PARTICULAR FUNCTIONALITY, OR THAT ES DEVICES WILL MEET THE REQUIREMENTS OF A PARTICULAR USER APPLICATION. LED LIGHTING TECHNOLOGIES GROUP, LLC DOES NOT WARRANT THAT ES DEVICES ARE ERROR-FREE, NOR DOES LED LIGHTING TECHNOLOGIES GROUP, LLC MAKE ANY OTHER REPRESENTATIONS OR WARRANTIES, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE FOREGOING STATES THE ENTIRE LIABILITY OF LED LIGHTING TECHNOLOGIES GROUP, LLC WITH RESPECT TO ES DEVICES.
